1. Definitions

• "Company" refers to Capital Curv, a subsidiary of Avinado Fintech Solutions Pvt. Ltd.
• "User" refers to any individual who accesses or registers on our platform.
• "Trader" refers to users participating in the evaluation process or funded accounts.
• "Platform" includes our website, mobile application, and digital services.

2. Eligibility

To use our platform, you must:

• ✅ Be at least 18 years old or meet the age requirement in your region.
• ✅ Provide accurate and complete registration information.
• ✅ Not be a resident of any restricted jurisdiction where trading services are prohibited by law.

3. Evaluation Process

By participating in Capital Curv's two-phase evaluation process, you agree to:

• ✅ Follow the rules outlined in the Trader Agreement.
• ✅ Meet the required profit targets and adhere to drawdown limits.
• ✅ Pay the evaluation fee, which is non-refundable except under conditions stated in our Refund Policy.
• ✅ Avoid any attempt to manipulate or exploit platform vulnerabilities.

Failure to comply may result in immediate disqualification.

4. Funded Accounts

If you pass the evaluation process, you may be eligible for a funded account. By accepting this account, you agree to:

• ✅ Follow the Risk Management Rules outlined by Capital Curv.
• ✅ Maintain consistent performance and adhere to drawdown limits.
• ✅ Accept that violating trading rules may lead to account suspension or termination.
• ✅ Acknowledge that payouts are subject to the agreed-upon profit-sharing model.

5. Fees and Payments

• ✅ Evaluation fees are charged upfront and are non-refundable unless otherwise stated in our Refund Policy.
• ✅ Profit payouts are processed based on the agreed profit-sharing structure.
• ✅ Traders are responsible for providing correct payment details to avoid payout delays.

6. Prohibited Conduct

Users are strictly prohibited from:

• ❌ Sharing evaluation or funded accounts with others.
• ❌ Engaging in copy trading, signal manipulation, or exploiting platform glitches.
• ❌ Using automated trading bots without prior written consent.
• ❌ Performing actions that violate Indian financial laws, SEBI guidelines, or Capital Curv's internal policies.

7. Intellectual Property

All content, branding, and materials on Capital Curv's platform are the property of the Company. Users may not:

• ❌ Copy, modify, or redistribute our content without written consent.
• ❌ Use our logo, trademarks, or branding without permission.

8. Privacy and Data Tracking

By using our platform, you consent to our Privacy Policy, which outlines how we collect, store, and protect your data. Capital Curv may:

• ✅ Collect and track IP addresses to detect account sharing or fraudulent activity.
• ✅ Store trading performance data for analysis and security purposes.
• ✅ Share data with third-party payment processors and brokers as required.

9. Limitation of Liability

Capital Curv shall not be liable for:

• ❌ Losses arising from trading activities or financial decisions.
• ❌ Technical issues or delays beyond our control.
• ❌ Data breaches caused by third-party providers or user negligence.

10. Dispute Resolution

In the event of a dispute:

• ✅ Users must submit a written complaint to our Support Team.
• ✅ Disputes will first attempt resolution through mediation.
• ✅ If unresolved, the dispute will be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 in New Delhi, India.

11. Changes to Terms and Conditions

Capital Curv reserves the right to modify these Terms at any time. Users will be notified of major changes, and continued use of the platform constitutes acceptance of the revised Terms.
